Terms of Service

1. Scope
These Terms of Service ("Terms") govern the use of the service "webermap" (the "Service"), offered by Lukas Weber, Weber Marketing, Achstraße 29, 88255 Baienfurt, Germany (the "Provider"). Deviating terms of the user do not become part of the contract unless the Provider expressly agrees.
2. Description of services
webermap is a web-based tool for creating, editing and collaboratively using mindmaps with AI support. The scope of functions results from the current product description and the chosen plan (Free or Pro).
3. Conclusion of contract & registration
The contract is concluded upon registration of a user account. The user is obliged to provide truthful information and to keep access credentials confidential. Registration is permitted to natural persons aged 16 and over as well as to businesses.
4. Prices & payment
The Free plan is permanently free of charge. The Pro plan costs €9 per month or €90 per year (each including statutory VAT where applicable). Billing is in advance via the payment provider Stripe. Price changes are announced at least 30 days in advance and apply from the next billing period.
5. Term & cancellation
Pro subscriptions renew automatically for the chosen period (month or year) and can be cancelled at any time with effect from the end of the current billing period. Cancellation is done via the user account. The right to extraordinary termination for good cause remains unaffected.
6. User obligations
The user undertakes not to use the Service abusively or unlawfully, in particular not to upload unlawful content and not to take measures that impair the availability or integrity of the Service.
7. Availability
The Provider strives for high availability but does not owe uninterrupted accessibility. Maintenance, force majeure or disruptions beyond the Provider's control may lead to temporary restrictions.
8. Liability
The Provider is liable without limitation for intent and gross negligence and for injury to life, body or health. For ordinary negligence the Provider is liable only for breach of a material contractual obligation (cardinal obligation) and limited to the foreseeable damage typical of the contract. Otherwise liability is excluded. The user is responsible for backing up their own data.

Information on the processing of personal data can be found in the privacy policy.
10. Changes to the Terms
The Provider may amend these Terms with effect for the future. The user will be informed of changes in good time. If the user does not object within 30 days, the changes are deemed accepted; this consequence will be pointed out separately.
11. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Insofar as the user is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the Provider's registered office. Should any provision be invalid, the validity of the remaining provisions remains unaffected.
